A convicted felon who was sentenced to a possible death sentence for killing a man in 2010 has been released from a Missouri prison and will be on probation for life. Sheriff's Department spokeswoman Martha Roush said the St. Louis County Sheriff's Department today released ex-convict Andrew Cole, 30, because he is "no longer a threat to the community." Cole was convicted of murder in the 2010 death of 21-year-old Joseph Pratt. A jury in 2012 sentenced Cole to life in prison. Cole's attorney requested a new trial based on newly discovered evidence that had been suppressed at his first trial. The new evidence included an interview that another inmate gave to a detective the day after the killing. The interview, which is part of a civil suit, said Pratt and Cole got into a fistfight and then another fight outside the victim's apartment, then ran into the apartment. Cole's trial attorney was permitted to cross-examine that inmate, Michael Lambert. But when Lambert was later called as a witness at Cole's second trial, he refused to testify and refused to be questioned. The Missouri Supreme Court ruled that Cole's lawyer should have been allowed to impeach Lambert. Lambert's testimony prompted Cole's acquittal on a charge of armed criminal action.
